Merlier is designated as the controller as it is the legal entity that determines the purpose and the legal and technical means for the processing of personal data. Merlier is the trading name of the following legal entity;

Merlier respects the privacy of the person concerned, in accordance with the applicable legislation (law on the protection of privacy of 8 December 1992). For all questions about your rights, you can always contact the Commission for the Protection of Privacy at the address: Waterloosesteenweg 115, 1000 Brussels.
Merlier uses third parties for the further processing of personal data. These third parties are referred to as actual processors. Naturally, the controller is extremely careful in its selection of actual processors. For example, the actual processor must provide sufficient guarantees with regard to technical and organizational security measures around the processing, and comply with the obligations of article 16, §1 privacy law.
The controller shall not bear or assume any liability for loss or corruption of data, identity theft, data theft, viruses or Trojan horses, SQL injections or other attacks on the computer systems or online cloud portals. The actual processor shall decide autonomously on the most technically suitable application to process the data, and shall do so on the basis of its professional expertise. The controller cannot be expected to have the same expertise and specialization.
Article 2:
Purpose of the processing
The personal data communicated to Merlier by the data subject via the Merlier website and/or in the context of the services offered thereon, will only be processed by Merlier for the following purposes:
- Processing of applications and purchases.
- The development of central clientele management.
- Dissemination of information, newsletters and (commercial) offers that are useful and/or necessary with regard to the data subject.
- Preventing irregularities and combating abuse and criminal behaviour.
- The proper technical functioning of our website; including the use of cookies, local storage information, information about the hardware and software used and log information such as the IP address and telecommunications data.
We absolutely do not use this information for any other commercial or similar purposes than those described here. Merlier will never forward information to a specialized party for an external analysis without prior anonymization. The processed personal data will not be sold, transferred or communicated to third parties. Data will nevertheless be communicated to third parties in exceptional cases if one of the following grounds is present:
- There is explicit consent from the data subject;
- When the transfer is necessary for the performance of the contract. This will be the case with employees, collaborators, agents, subcontractors, suppliers, commercial partners, marketing services, etc.;
- When the transfer is necessary for the conclusion or performance of a contract concluded or to be concluded in the interest of the User between the controller and a third party. For example, in the context of fraud;
- When the transfer is necessary or legally required (important public interest or right);
The personal data communicated by the Data Subject are processed by Merlier in strict confidence. However, since the use of the Internet does not offer complete security, respect for personal privacy can only be guaranteed if the personal data are communicated by means of communication options that Merlier expressly indicates are secure.
Article 3: We use cookies
Cookies are used on our website. A cookie is a small file that is placed on the hard drive of your computer from the website server when you visit the website. The code that is processed in the cookie allows the device (PC, telephone, tablet, television, etc.) with which you are surfing to be recognized on a subsequent visit. The cookie cannot be read by other sites than the one that created it. The information in the cookies cannot be linked to a name. You can refuse the installation of cookies and remove cookies that have already been installed from your computer via your browser settings.
We use different types of cookies:
Firstly, there are the so-called ‘session’ cookies. These cookies are assigned to your computer during the surfing session and are necessary for the proper functioning of our website. If you refuse these cookies, it is possible that certain parts of the site will no longer be accessible. When you close the browser, the session cookies are automatically deleted from the hard drive of your computer.

When visiting the Merlier website, some data is collected for statistical purposes provided by Google Analytics. The user knows that, in accordance with the terms of Google AdSense, third parties are expressly authorized to place and read cookies on the browser of Merlier Users, web beacons are permitted to collect information, and advertisements can be displayed on the Merlier Website.
Article 4: What are my rights?
1) Guarantee of lawful and secure processing of personal data.
Every person involved can assume that Merlier always processes personal data ‘fairly and lawfully’. This means that the data is only processed for the above explicitly described and justified purposes. Merlier therefore guarantees that the data processing is always adequate, relevant and not excessive.
We never store personal data longer than strictly necessary. We do keep an archive of the data, as long as your account is active, or when your personal data is necessary to be able to offer you a certain service.
Merlier has taken sufficient technical and organizational security measures to guarantee you safe processing of personal data. These security measures are in proportion to the nature of the personal data and the potential risks.
The risks of accidental or unauthorized destruction, accidental loss, modification of or access to, and any other unauthorized processing are therefore reduced to a minimum. Unfortunately, this does not mean that there is no longer any risk. In the event of a break-in to its computer systems, Merlier will immediately take all possible measures to limit damage and/or theft to a minimum.
2) Right to object.
Any data subject may always object to the processing of his personal data. This right to object only exists if there are serious and justified reasons related to his particular situation. The exceptions of article 5, (b) and (c) Privacy Act also apply to this right to object.
The data subject may at any time, free of charge and without giving reasons, object to the intended processing of his personal data if these personal data were obtained for direct marketing purposes.
The data subject is also entitled to obtain at any time, free of charge and without giving reasons, the deletion of or a prohibition on the use of all personal data concerning him or her which, taking into account the purpose of the processing, are incomplete or irrelevant, or the recording, communication or storage of which is prohibited, or which have been retained after the permitted period has expired.
The data subject exercises his right via a dated, written request to Merlier, by post or by e-mail via info@merlierslijperij.be. Merlier undertakes to respond to your request within 15 working days.
3) Right of access.
Any data subject who proves his identity has a right of access to information concerning the existence or otherwise of processing of his personal data, as well as the purposes of such processing, the categories of data to which such processing relates and the categories of recipients to whom the data are disclosed.
The data subject exercises his right by means of a dated, written request to Merlier, by post or by e-mail to info@merlierslijperij.be. Merlier undertakes to respond to your request within 15 working days.
4) Right to rectification.
Merlier is committed to collecting data as accurately as possible. Inaccurate or incomplete personal data can therefore always be improved or even deleted. Since it is impossible to be continuously aware of every change or error in the personal data, it is up to you as a data subject to report inaccuracies and incompleteness and to make the necessary adjustments yourself in the first place.
If this is still not sufficient, you can always send a dated, written request to Merlier, by post or by e-mail to info@merlierslijperij.be. Merlier undertakes to respond to your request within 15 working days, by supplementing, improving or even deleting the personal data in whole or in part. The deletion mainly concerns visibility, so it is possible that the deleted personal data will still be temporarily stored.
